Members of the professional bodies listed below are able to seek advice direct from Counsel or may instruct Counsel in non-court litigation (DPA). Previously, only solicitors and a few notable exceptions, such as patent and trademark agents, could instruct Counsel direct.
DPA does not include instructing barristers to appear in the higher courts or the county courts or Employment Appeal Tribunals, or if at any stage a barrister considers that the interests of the lay client or the administration of justice require that a solicitor be instructed.
